AFFIDAVIT EMERGENCY MOTION TO ADVANCE CASE ON APRIL 6, 2000:
ORDER TO COMPEL COMPLAINANT TO DELIVER WITNESS NAMES AND ADDRESSES

NOW COMES the defendant, Gale A., by pro se, and still upon her word as a Judaic-Christian and under penalties of perjury as in numerous filings in this case before a notary and having served notice for proper hearings of her motion and states that:

  1. The defendant presently is charged with one offense of harassment by telephone, 720 ILCS 135/1-1 and one offense of harassment by electronic media, 720 ILCS 135/1-2.
  2. She has a Constitutional right to call witnesses to her defense.
  3. She has a Constitutional right to due process.
  4. The witnesses she needs to call are known by the complainants.
  5. On November 18, 1999 the Court noted that the defendant has a right to these witnesses' home addresses in advance of trial in order to investigate the witnesses.
  6. The defendant wants her motion to compel the complainants to deliver to her witness names and addresses heard well in advance of start of trial by jury selection, scheduled for May 15, 2000.
  7. In a conversation with the Clerk on March 23, 2000, when she was in Court to advance her case but her judge was not, the clerk told her to give at least two weeks notice on having her motions heard and the substitute judge, Judge Luckman, told her that she could submit Emergency Motions before May 15, 2000, which this is, and a notice to advance for this motion was filed with the clerk and served on the state on March 23, 2000.

8. The defendant did give the two weeks notice, though considering the fact her motions have been before the court for several months and that she has scheduled numerous hearings on different dates -- to have them heard -- but something else always happened instead so she has yet to have them heard, she wants it on record that she objects to this further delay -- she should have had the names and addresses of these witnesses long before this date in order to already be investigating and preparing for trial.
