AFFIDAVIT MOTION TO
DISMISS THIS CASE WITH PREJUDICE
NOW COMES the defendant, Gale A., by pro se, and still upon her word as a Judaic-Christian and under penalties of perjury as in numerous filings in this case before a notary and according to rules of Criminal law and in the interest of justice, moves this court to dismiss this case with prejudice and states that:
- The state and court seem reluctant to progress her case in that the state has stonewalled on providing a bill of particulars and discovery and the Court has put off on hearing her substantial motions allowing her to prepare a proper defense until the same day as jury selection for trial -- causing the defendant delays and obstacles in preparing her defense.
- The state will have a hard time proving this defendant's intent to harass since such never existed, even with lying, exaggerating and committing overzealous acts of prosecution and other forms of prosecutorial misconduct and the state will certainly have a hard time stacking the jury with robber barons from the UK.
- She has hired a lawyer to handle her civil actions against the complainants and the company Wrox so all future contact concerning her complaints against Wrox will come from this attorney and she will be making no further direct contact to anyone at Wrox and she continues talks with other attorneys for support and/or back-up, mostly independents but also some attorneys from the law firm Winston and Strawn.
- She has filed a wage claim against Wrox with the Illinois Department of Labor.
- It's to her best knowledge and belief that the complainants and the state brought this case against her to coerce her into silence as opposed to winning an actual conviction against her, an act that qualifies under the law as a bad faith prosecution, and she also considers it bad faith that the state refuses to act on the complainants' criminal conduct of withholding wage and wage supplements from the defendant.
- The complainants and the state got what they wanted from this defendant, forcing her to move forward on civil action, which she has done and which means she cannot and will not be able to make any further direct contact with the complainants nor anyone at Wrox.
7. She has received an over abundance of punishment in this case already although she is innocent, although she has received not a single piece of paper nor shred of evidence against her and without her being given any chance at all to defend herself while all the while it is the thieving complainants who are the true criminals in this case as everyone involved in this case surely knows. Or whom among you gets up, goes to work everyday of your life simply to work for the opportunity to give your labor and genius away?
