MOTION TO DISMISS: 14th Amendment

NOW COMES the defendant, by pro se, and moves this Court to dismiss this case pursuant to The Constitution of the United States, Amendment 14, and in support thereof states as follows:

    1. That the defendant presently is charged with the offense of harassment by telephone, 720 ILCS 135/1-1.
    2. That the State violated defendant's right to equal protection under the law -- the State exhibited class bias by choosing to prosecute defendant who is of working class and choosing not to prosecute complainant, Adam C. Maclean, who is an extremely wealthy businessman.
    3. Whereas defendant turned in to the State's Attorney office a complaint against Adam C. Maclean on or around July 24, 1999 and again on or around September 20, 1999 for his theft of her sales commissions, among other monies and other predatory business practices and;
    4. whereas the State's Attorney, obligated by law to exercise due diligence, should have ascertained through the evidence brought by complainant against the defendant that defendant had just cause in seeking redress and that the complainant himself had committed crimes against the defendant, and committed them prior to any charges complainant brought against her. Such evidence being "a huge stack" according to the police at 3151 W. Harrison that complainant went to, and the police detective expressed to defendant that he understood from this stack of materials that the complainant wronged the defendant

Wherefore the defendant asks that the above charge be dismissed against the defendant, filing this motion in a reasonable time after arraignment as a pro se defendant, and;

wherefore defendant asks for latitude in pleadings and procedures as a pro se defendant as in the doctrine from Picking v. Penn Railway, 151 F2d 240, and;

wherefore defendant asks for expense damages from complainant in the amount of: $280.00 for legal research materials and miscellaneous expenses related to her defense such as travel, postage and photo copies and an additional amount of $2,400.00 for pro se fees in that defendant spent at least 80 hours in legal research and preparation, for a total of $2,680.00.
