MOTION FOR COURT INFORMATION: JUDGES AND CLERKS

NOW COMES the defendant, by pro se, to request that the court, in the interest of Justice and in compliance with various Freedom of Information Acts, supply information on any and all judges hearing her case and these judges' law clerks and in support thereof states:

  1. That the defendant presently is charged with the offense of harassment by telephone, 720 ILCS 135/1-1.
  2. That a judge's role and that of his clerks is one of impartiality.
  3. That the defendant is representing herself Pro Se in this case.
  4. That the prosecution agents have a distinct advantage over the Pro Se defendant in front of the judge through working knowledge and a shared commitment to the legal community.
  5. That the defendant has no knowledge of any or all of the cases the judge(s) and/or judge's law clerk(s) have been involved in.
  6. That the Pro Se defendant has been instructed by the court on November 18, 1999 that she is to be held at the same standards as licensed, practicing attorneys, including those charged with the duties of prosecuting the case.
  7. That the Clerk for the Circuit Court of Cook County will supply the defendant with transcripts of cases only by case number or name of defendant.
  8. That the defendant is not working and cannot afford access to Westlaw nor Lexus Nexus databases to more vigorously search cases.
  9. That the defendant is entitled to get this information in as expeditious and fair manner as possible in order to proceed to trial.
  10. Whereas the defendant wants the name and resumes of any and all of the judges' law clerks involved in this case.
  11. Whereas the defendant wants to know three (3) names and/or case numbers of defendants prosecuted for making a telephone call with the intent to harass whose cases proceeded to jury trial and a jury trial was held and those mentioned in paragraph 2 presided as judges or law clerks, three cases for each party.
  12. Whereas the defendant wants to know up to three (3) names/or case numbers of defendants prosecuted for the same type of crime, by classification, whose cases proceeded to jury trial and a jury trial was held and those mentioned in paragraph 2 presided as judges or judge's law clerks, up to three cases for each party. This is only if there are not sufficient cases mentioned in paragraph 11 to comply with this request.

WHEREFORE, the defendant moves this court to grant the motion for information on any and all judges and judges' law clerks involved in this case by date certain.
