No. 99329469

MOTION FOR COURT-APPOINTED ASSISTANCE OF COUNSEL
TO PRO SE DEFENDANT

NOW COMES the defendant, by pro se, and asks the court to allow her court-appointed assistance pursuant to Sup. Ct. Rule 401, Note 14 which states that it is within the trial court's discretion to allow such, and in support thereof states:

    1. That the defendant presently is charged with the offense of harassment by telephone, 720 ILCS 135/1-1.
    2. That the defendant and her common law husband did in the 1980's through cases becoming related to those during "Operation Greylord" suffer serious harm and trauma from many attorneys, including attorneys whom under normal circumstance are considered "cream of the crop". Sandra Sirkin v. Robert Z. Warren in Syracuse, New York.
    3. That the defendant being out of work and with limited assets cannot afford to hire an attorney in this charge as cited in paragraph 1.
    4. Whereas since the 1980's, the defendant prefers to represent herself during any judicial proceeding but does prefer competent assistance with the technicalities of legal procedure and knowledge of substantive law.
    5. That the defendant reads the Chicago Tribune daily.
    6. That the Chicago Tribune has for the past year done several investigative stories about inadequate public defenders going up against over-zealous prosecutors who for some reason are better funded by the state than the public defenders, the latest news series running the week of November 14 - 20, 1999, during which time defendant in this instance had her first court appearance at Branch 46 on November 18, 1999.
    7. That the defendant, overheard discussions in the 13th and Michigan court building of other defendants unhappy with their public defenders and overhead none where they expressed confidence.
    8. Whereas these incidences have further eroded the defendant's confidence in accepting a public defender as her gatekeeper to justice.

WHEREFORE, the defendant moves this court to grant the motion for court-appointed assistance to advise pro se defendant by date certain.
