AMENDMENT TO MOTION TO PROCURE BUSINESS RECORDS FROM COMPLAINANT
AND FOR COURT TO WARN COMPLAINANT AGAINST DESTROYING/HIDING RECORDS
- That the process of Subpoena Duces Tecum is not sufficient process to procure necessary records form the complainant.
- That the State has the resources to go to defendants' places of business and elsewhere with experts, warrants, sheriffs and other agents.
- That the defendant, an equal taxpayer and user of the courts as the state, is in need of expert witnesses but cannot afford them.
- That the defendant has saved the state money in terms of usage of a public defender.
- That there is no one currently employed at the complainant's business with the financial and computer systems knowledge and objectivity to gain sufficient business data from the complainant.
- That the state should pay for expert financial/computer system expert witnesses for the defendant as the court deems reasonable.
- That any and all such expert, impartial witnesses be allowed access to complainant's computers and hard files at his place of business and home.
