AFFADIVIT AMENDMENT TO DEMAND COMPETENT PROSECUTION:
REMOVAL OF PATTI ESHAEI AS PROSECUTING ATTORNEY,

DENIAL OF JURISDICTION IN THIS CASE BY JUDGE SMITH

NOW COMES the defendant, Gale A., by pro se, and still upon her word as a Judaic-Christian and under penalties of perjury as in numerous filings in this case before a notary and asks the court and the state to amend her previous motions and amendments in regards to the demand for competent prosecution and states that:

  1. If the Court finds this fourth amendment to the motion for Competent Prosecution frivolous, that the defendant respectfully objects to that in advance, asks for the motion to stand for appellate review of its merits and will accept whatever sanction the Court deems necessary to put upon her in her disagreement of this motion's frivolity vs. meritorious factors. "Blessed are those who are persecuted for the sake of justice". St. Matthew.
  2. On March 2, 2000, the defendant came to the courtroom of 501 to observe proceedings while also being in the building on business to file amended motions to advance her case which she was forcefully denied to do and her intention of wanting to observe proceedings in order to learn without being under the emotional and mental tension of having court business in a hearing for herself which she was also forcefully denied.
  3. Judge O'Malley was not there that day, but a different Judge, Judge George Smith was there.
  4. Patti Eshaei with malice and criminal aforethought took this opportunity to bushwhack the defendant through prejudicing a new judge ex parte, knowing that the defendant does not rise for Court, as she was given permission to do by Judge O'Malley.
  5. Judge Smith and Patti Eshaei called her to the bench as their first order of business, charged her with an I-Bond violation for breaking bond for not rising, though this contract had already been revised verbally in court as known by Eshaei but that Judge Smith would not hear any argument from the defendant and required her to get a D-Bond, a process involving the defendant being taken into custody on the spot, bused to 26th and California, processed as a criminal and jailed overnight while awaiting someone to bail her out and that the defendant became severely physically ill after this experience, fears walking into a courtroom again and has had difficulty sleeping ever since.
  6. Various bailiffs are witness to this and stated to the defendant while taking her into custody that they thought Eshaei's actions were improper and way out of bounds.
  7. The defendant does not agree that Patti Eshaei and Judge Smith were within the spirit of the law to do this, nor does she feel it was a proper or worthy tactic for them to take but rather it was indeed criminal and a malicious retaliation for the defendant's vigorous defense and earlier requests for competent prosecution -- disregarding that a Pro Se defendant has full rights to protect herself in a prosecution from misbehaving prosecutors, pursuing free speech and lest we forget, her rightful wages and wage supplements where all this began!
  8. The defendant has reason to believe that this unfair prosecution against her is continuing simply because it was a case that was accepted and acted upon by the state and that the prosecution refuses to dismiss this case with prejudice or to drop charges as a matter of ego, further evidence of prosecutorial incompetence and misconduct.
  9. It's well within the defendant's rights to demand that a worthy person represent the state, which includes herself as defendant, as opposed to someone who lets power control her rather than she controlling it, she feels she has a right to demand this from the lowest to the highest rungs in the system, being the one with the most to lose and the one subjected to awesome powers and terrible punishments and while presumed innocent. She wants it noted that as a Judaic-Christian she holds no malice toward Eshaei, prays for her soul but that that is really Eshaei's individual rights problem but that certainly in lieu of Eshaei's actions which prove un-Judaic and un-Christian, that she cannot be entrusted with power, that she be removed from this case at once and that Judge Smith never be given jurisdiction over her case in any absences of Judge O'Malley.
